5/3/10: 2nd dispute with Experian

5/3/10

To Whom It May Concern:

Experian received my 1/12/10 credit disputes on 1/15/10 along with copies of my driver’s license and utility bill.

On 1/20/10 Experian notified me that it had determined that my disputes were not sent by me, that it would not respond to future disputes and that it notified law enforcement and federal agencies.

Not only did I send the disputes myself, but I even provided my Social Security Number and I enclosed a copy of my driver’s license and utility bill!

Experian stated in its 1/20/10 notice:

“Any future requests made in this manner will not be processed and will not receive a response.

Notably, Experian had no problem providing me with my credit report on 1/7/10 when I ordered at its ConsumerInfo.com site www.protectmyid.com and I did NOT  provide ANY documentation.

Since Experian refused to investigate my disputes and advised that it would refuse future disputes, I am requesting the assistance of the FTC.

My FTC complaint is enclosed for your convenience and published at http://liarsandcheats.info/credit-bureau-experian-refusal-to-investigate-factual-disputes/

1) Please identify all law enforcement and federal agencies Experian contacted regarding my disputes.

Experian wrote on 1/20/10:

“Suspicious requests are taken seriously and reviewed by Experian security personnel who will report deceptive activity, including copies of letters deemed as suspicious, to law enforcement officials and to state or federal regulatory agencies.”

I hoped that law enforcement and regulators would contact me, but to date, I have not heard from anyone about this alleged “deceptive activity.”

Please provide me with the contact information for all agencies you have notified about this matter and with the case numbers.

2) Please explain how Experian made the determination that my factual credit disputes were not sent by me.

My 1/12/10 disputes were sent by me. It is utterly ridiculous to claim otherwise.

3) Please immediately delete both LVNV accounts, as requested in my 1/15/10 dispute.

Since Experian claims to be so concerned with fraud and deception, I hereby also request that it immediately terminate the LVNV access to consumer credit reports and that Experian delete ALL LVNV collections on ALL consumer reports as LVNV engages in illegal debt collection and credit reporting practices.

4) Please immediately correct the reporting of my student loans.

I disputed on 1/12/10:

“Please correct the obviously incorrect reporting of my Sallie Mae student loans with the Credit Limit/Original Amount LESS than the CURRENT balances. As the balances on deferred student loans continually increase, the original loan amounts are to be updated accordingly.”

Please correct the reporting of ALL student loans for ALL consumers as most student loans are reported incorrectly and this practice lowers the FICO scores.

FICO scores are required for almost all mortgage applications.

5) Please also delete the HSBC, Chase and GE Capital/PayPal charged off accounts.

Derogatory accounts can only be reported for 7 years.  Apparently, these accounts are NOT scheduled to be deleted as there is no scheduled deletion date on the Experian credit report as for other derogatory accounts: “This account is scheduled to continue on record until Aug 2014.”

Please delete all derogatory accounts not scheduled for deletion.

Like many millions of Americans, I am extremely busy.  I really don’t have the time and money to continually purchase credit reports and to dispute information that is either OBVIOUSLY incorrect (the student loan balances) or incomplete (derogatory accounts not scheduled for deletion) or is reported by collectors like LVNV who routinely engage in unfair and deceptive collection practices and incorrect credit reporting.

Sincerely,

  1. They are garbage. I have the same problem every time I try to get my credit report from any three of these fraudulent bureaus. They are clearly running an illegal and slanderous industry and the FTC doesn’t seem to regulate anything they do. They can lie and ruin a persons chance at the American Dream then they don’t even let us have a chance to defend ourselves or correct their mistakes. It is flat out unconstitutional.

  2. You are feeling my plight. I have been fighting with ID Theft since beng made aware of 29 Jun 2010.

I have no less than 50 inquiries to Experian. I’ve included the Police Report, Dept of Justice complaint, Fed. Trade Comm. complaint. Not until the DOJ stepped in and wrote a letter of inquest, did I get help.

The little assistance I am receiving is not really work a damned!!

  3. You should have gotten an attorney to sue them and you probably still can.

I know it’s a hassle, but that’s often what it takes unless you publish their violations of the law.
